1. Data Controller

Sithappy S.L. ("Sithappy", "we", "us") is the data controller responsible for your personal data. We are registered in Spain and operate the Sithappy platform at sithappy.co.

2. What Data We Collect

We collect different categories of personal data depending on how you use the Platform:

Account Information

When you create an account we collect your name, email address, phone number, preferred language, and role (parent or sitter). For sitters we also collect your date of birth, bio, experience, languages spoken, and zone preferences.

Identity Verification

Sitters are required to complete identity verification through our partner Veriff. This involves uploading a government-issued ID document and a selfie. Veriff processes this data as a separate data controller under their own privacy policy.

Children's Information

Parents may add children's first names and ages to their profile to help sitters prepare for visits. We collect the minimum information necessary and never share children's details publicly.

Usage Data

We automatically collect device information, IP address, browser type, pages visited, and interaction data to improve the Platform and ensure security. For logged-in users we record first-party operational analytics - the routes you visit and the active time you spend in the Platform - to monitor performance, detect abuse and improve the product. We do not use third-party trackers for this. Raw event data is retained for 90 days; aggregated, non-identifying summaries may be kept longer.

Payment Information

Payment processing is handled by Stripe. We do not store your full card details. Stripe acts as an independent data controller for payment data under their own privacy policy.

3. Legal Basis for Processing

We process your data under the following legal bases: (a) Contract performance - to provide the Platform services you have requested; (b) Legitimate interests - to improve our services, prevent fraud, and ensure platform safety; (c) Legal obligation - to comply with Spanish law, EU regulations, and tax requirements; (d) Consent - for optional marketing communications, which you can withdraw at any time.

4. How We Use Your Data

We use your data to: create and manage your account; match parents with available sitters; process bookings and payments; send transactional emails (booking confirmations, reminders); verify sitter identities and qualifications; provide customer support; improve the Platform through analytics; and, where you have consented, send marketing communications about Sithappy.

5. Data Sharing

We share your data with: other Platform users as necessary for bookings (e.g. a parent sees a sitter's name, photo, bio, and verifications; a sitter sees a parent's name and children's first names); Stripe for payment processing; Veriff for identity verification; Resend for transactional emails; Vercel for hosting; Supabase for database services; and Mapbox for location services. We do not sell your personal data to third parties.

6. International Transfers

Some of our service providers are based outside the European Economic Area (EEA). Where data is transferred outside the EEA, we ensure appropriate safeguards are in place, including EU Standard Contractual Clauses or adequacy decisions by the European Commission.

7. Data Retention

We retain your personal data for as long as your account is active or as needed to provide services. After account deletion, we may retain certain data for up to 5 years to comply with legal obligations (e.g. tax records) or to resolve disputes. Anonymised analytics data may be retained indefinitely.

8. Your Rights

Under GDPR and Spain's LOPDGDD, you have the right to: access your personal data; rectify inaccurate data; erase your data (right to be forgotten); restrict processing; data portability; object to processing; and withdraw consent. You can exercise most of these rights directly from your account settings, or contact us at hello@sithappy.co.

9. Children's Privacy

Sithappy is a service for parents and adult childcare providers. We do not knowingly collect personal data directly from children under 16. Children's names and ages provided by parents are stored securely and shared only with confirmed sitters for the purpose of providing care.

10. Cookies

We use essential cookies to keep you logged in and remember your preferences. We use analytics cookies (only with your consent) to understand how the Platform is used. You can manage your cookie preferences at any time through the Cookie Settings link in the footer.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or through a notice on the Platform. The "Last updated" date at the top of this page indicates when the policy was last revised.
